Agreement to Terms
MyCareHuddle, LLC ("MyCareHuddle," "we," "us," or "our") owns and operates the MyCareHuddle mobile application and website at MyCareHuddle.com (collectively, the "Platform"). These Terms of Use ("Terms") constitute a legally binding agreement between you and MyCareHuddle governing your access to and use of the Platform.
By creating an account, downloading the app, or using any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use MyCareHuddle.
These Terms apply to all users of the Platform, including administrators ("Admin users") who create and manage care recipient profiles, and caregivers who are invited to participate in a care team.
What MyCareHuddle Is (and Is Not)
MyCareHuddle is a care coordination platform that helps families and caregivers organize information, track medications, log daily care activities, schedule appointments, and communicate as a team.
MyCareHuddle does NOT provide medical, clinical, legal, financial, or professional advice. It is not a medical device, a telehealth service, or a substitute for licensed healthcare professionals. Nothing in the Platform should be interpreted as medical advice or a clinical recommendation.
For medical questions, emergencies, or clinical decisions, always consult a licensed healthcare professional or call emergency services (911).
MyCareHuddle is not a document repository or system of record for legal, financial, or medical records. Any files or information you add to the Platform are for care-coordination convenience only. Always keep original documents — such as wills, powers of attorney, advance directives, and insurance policies — in a safe location outside the Platform, and do not rely on the Platform as your only copy of any important document.
Who Can Use MyCareHuddle
To use MyCareHuddle, you must:
- Be at least 18 years old
- Have the legal capacity to enter into this agreement
- Not be prohibited from using the services under applicable law
If you are adding information about another person (such as a care recipient), you confirm that you have their permission or legal authority to do so — for example, as a parent, legal guardian, healthcare proxy, or power of attorney.
You agree to provide accurate information, keep your login credentials secure and private, and notify us promptly at support@MyCareHuddle.com if you believe your account has been compromised.
Admin and Caregiver Roles
Admin Users
Admin users create and manage care recipient profiles. By using MyCareHuddle as an Admin, you confirm that you have appropriate legal authority to manage health information for the care recipient and to invite caregivers to access that information. You are responsible for managing caregiver access and removing access when it is no longer appropriate.
Caregiver Users
Caregiver users are invited by Admin users and may access care recipient information as permitted by the Admin. By accepting an invitation to a care team, you agree to use the information you access only for the purpose of providing care for the designated care recipient, and to maintain the confidentiality of all health information you encounter through the Platform.
Using MyCareHuddle Responsibly
You may use MyCareHuddle for personal, family, or client caregiving purposes. You agree NOT to:
- Use the Platform to harass, threaten, or harm any person
- Share another person's health information beyond what is necessary for their care without their consent
- Attempt to hack, disrupt, overload, or compromise our systems or security
- Copy, sell, license, or resell the Platform or any part of it
- Reverse-engineer, scrape, or access any part of the Platform you are not authorized to access
- Use the Platform in violation of any applicable law or regulation
- Impersonate another person or falsely claim authority you do not have
We may suspend or permanently close your account if you violate these Terms.
Content and Data You Add
You are responsible for the accuracy and appropriateness of information you enter into MyCareHuddle. You represent that you have the authority and consent necessary to enter and share any health information you add to the Platform.
By using MyCareHuddle, you grant us a limited license to use your information only as needed to operate and improve the Platform, including to provide features like reminders and sharing with invited care team members, maintain security and performance, and create de-identified aggregate statistics that do not identify you or the person receiving care.
You retain ownership of your personal and health information. We do not claim ownership over the content you enter.
Intellectual Property
The MyCareHuddle Platform — including its design, software, features, trademarks, logos, and all content created by us — is the exclusive property of MyCareHuddle, LLC and is protected by copyright, trademark, and other applicable laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the Platform without our written permission.
Plans, Pricing, and Payments
MyCareHuddle may offer free and paid subscription plans. Pricing and features are described in the app or on our website and are subject to change with notice.
For paid subscriptions: subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel at any time through your account settings. Cancellations take effect at the end of the current billing period — we do not provide prorated refunds for unused time unless required by applicable law. All fees are stated in US dollars and are exclusive of applicable taxes.
We reserve the right to change pricing with at least 30 days advance notice to existing subscribers.
Account Termination
Termination by You
You may close your account at any time by accessing account settings or contacting us at support@MyCareHuddle.com. Upon closure, your data will be deleted or anonymized within 90 days as described in our Privacy Policy.
Termination by MyCareHuddle
We may suspend or terminate your account, with or without notice, if we believe you have violated these Terms, if your use poses a security risk to the Platform or other users, if required by law, or if we discontinue the Platform. In the event of termination, you will lose access to your account and its data. We will provide reasonable notice and data export options where legally required.
Updates to the Platform and Terms
We may update MyCareHuddle or these Terms from time to time. For material changes to these Terms, we will provide at least 30 days advance notice by email or in-app notification before changes take effect. For minor changes (such as clarifications that do not affect your rights), we will update the "Last Updated" date at the top of this document.
Your continued use of MyCareHuddle after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using MyCareHuddle and may close your account.
Disclaimer of Warranties
MyCareHuddle is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any defects will be corrected.
You use MyCareHuddle at your own risk. We are not responsible for any care decisions made based on information entered into or generated by the Platform.
Limitation of Liability
To the fullest extent permitted by applicable law, MyCareHuddle and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages resulting from your use of or inability to use the Platform.
Our total cumulative liability to you for any claims arising from your use of MyCareHuddle will not exceed the greater of (a) the amounts you paid to us in the 12 months preceding the claim, or (b) $100 if you are a free user.
Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, these limitations apply only to the extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless MyCareHuddle, LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, your violation of any third party's rights, or any content you submit that is inaccurate, unlawful, or violates another person's rights.
Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Most disputes can be resolved by contacting us at support@MyCareHuddle.com. We encourage you to reach out before initiating any formal process.
For disputes that cannot be resolved informally: any claim or dispute arising out of or relating to these Terms or your use of MyCareHuddle will be resolved through binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association (AAA), rather than in court. This means you waive your right to a jury trial and to participate in a class action lawsuit.
Exceptions: either party may seek emergency injunctive relief in court to prevent irreparable harm, and either party may bring claims in small claims court for disputes within that court's jurisdiction.
If the class action waiver is found unenforceable, the arbitration provision will not apply to that claim.
Apple App Store Terms
If you download or use MyCareHuddle through the Apple App Store, the following additional terms apply:
- These Terms are an agreement between you and MyCareHuddle, LLC only — not with Apple Inc. ("Apple"). Apple is not responsible for the Platform or its content.
- Your license to the app is limited to a non-transferable license to use it on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service (except as permitted by any applicable Family Sharing rules).
- Apple has no obligation to provide any maintenance or support services for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar laws.
- If a third party claims the app infringes its intellectual property rights, MyCareHuddle — not Apple — is responsible for the investigation, defense, settlement, and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. To the extent a dispute is not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in New Jersey.
